Ovarian Cancer victim wins $417m payout from Johnson & Johnson

Johnson & Johnson talcum power is typically associated with kid’s bath times or a grandparent’s bathroom cabinet and has been a household staple for generations

In the United States a jury has now ordered Johnson & Johnson to pay $417m to a woman who claimed she developed ovarian cancer after using the company’s talc-based products for feminine hygiene.

Without Warning

The verdict in favour of California resident Eva Echeverria is the largest yet in lawsuits brought by women.

It has been successfully claimed that Johnson & Johnson failed to warn consumers adequately about the cancer risks of its talc-based products.

In a similar case, ovarian cancer sufferer Deborah Giannecchini of Modesto, California, was awarded more than £58million.  She claimed Johnson’s baby power made her ill.

Cancer Risk

Some studies have found that women who regularly use talc on their genital area face up to a 40 per cent higher risk of developing ovarian cancer.  The International Agency for Research on Cancer classifies genital use of talc as “possibly carcinogenic”. Other research, however, has shown either no link or a weak link between cancer and the product.  Most major health groups have declared talc harmless.

Lynch Solicitors have over thirty years’ experience in acting in defective products cases and cancer related medical negligence actions.  We have acted in cancer misdiagnosis cases.

Detecting cancer when it is in the early stages of development usually means that treatment methods are far more effective. However, despite advances in modern technology and medical imaging tests, the misdiagnosis of cancer is also more common.

Compensation

When screening tests for cancer are performed as a matter of course, and a doctor or cancer specialist fails to identify the signs of cancer, you may be entitled to make a cancer misdiagnosis claim for compensation.

If you require further information about any of the issues raised or if you suspect that you have been a victim of misdiagnosis please contact us. Our expert medical negligence solicitors specialise in Cancer misdiagnosis claims. We can provide clients with immediate legal advice following what is a very traumatic time in their lives.
