On Tipp FM John M. Lynch spoke to Seamus Martin about recent developments in Guardianship – What is it? Who can be appointed a Guardian? What are the rights for unmarried parents in Guardianship? He also discussed the rights and duties of those who are Guardians and a recent Supreme Court case which set out the standards on the issue.

Guardianship is an umbrella term that applies to a number of different elements of childcare. When people separate and there are children involved the issue of guardianship maybe, important one.

It is important to understand that guardianship does not equate to custody or access .  Guardianship involves responsibility for decision-making on broad childcare matters – such as choice of school or chosie of religion.

Issues such as custody, access and primary carer will also arise on separation.
